Terms of Service

Last updated: 29 September 2026

1. Who we are

These terms are an agreement between you and Fourth Generation Technologies (Pty) Ltd, a company registered in Botswana under registration number BW00001816431 ("we", "us"). Our registered office is Plot 11662/A, Mogoditshane, Botswana. Our place of business is Plot 27860, Block 3, Gaborone, Botswana (postal: P.O. Box 550152, Mogoditshane, Botswana). You can reach us at support@fourthgeneration.technology or on +267 74339657 or +267 71473079.

By creating an account, placing an order or using any of our services, you accept these terms. If you accept them on behalf of an organisation, you confirm you are authorised to bind it.

2. Our services

We provide cloud, hosting, domain, email, security and software services, and the support that goes with them. Each service's page in the Cloud Console describes what is included, what is not, its price and any minimum term. That description forms part of this agreement.

Some services are supplied by other companies, including Microsoft, Google and domain registries. Where a service comes from one of them, you also agree to that company's customer terms, which we will point you to when you order. If their terms change in a way that affects your service, we will tell you.

3. Your account

You must give accurate information and keep it up to date. You are responsible for everything done through your account, including by people you invite to it. Two-step login is required on every account. Tell us straight away if you believe your account has been accessed without permission.

4. Ordering and electronic contracts

Before you confirm an order, the Cloud Console shows you the full price, including taxes and fees, and lets you review and correct your order or cancel it. Your order is an offer to us. The agreement for that service is formed when we confirm your order. You can view and download a full record of every order and invoice in the Cloud Console for as long as your account is open, and for 12 months after it closes.

We will start providing a service within 30 days of your order unless the service page gives a different time or we agree otherwise. If we cannot, you may cancel by giving us seven days' written notice, and we will refund anything you have paid for that service.

5. Fees, billing and payment

Services are billed monthly in advance in the currency of your account, unless the service page says otherwise. Changes made during a month are charged or credited for the part of the month they apply to. Invoices are available in the Cloud Console. You may pay by card through our payment provider or by bank transfer using the invoice reference.

Prices for services we buy from others in foreign currency are set monthly and stay fixed for that month. We will give you at least 30 days' notice of any other price increase.

If an invoice is not paid by its due date, we will send reminders. If it remains unpaid 14 days after the due date, and after at least two reminders, we may suspend the affected services after giving you written notice. We will not delete your data for at least 30 days after suspension. Services are restored once the overdue amount is paid.

6. Cancelling services

You may cancel a monthly service at any time in the Cloud Console. It stops at the end of the billing month already paid for. Services with a minimum term, such as annual Microsoft commitments, can only be reduced or cancelled as set out on the service page. Our Refund and Cancellation Policy forms part of these terms.

7. Acceptable use

You must not use our services to:

  • break any law, or infringe anyone's intellectual property or privacy;
  • send unsolicited bulk email or any marketing that does not meet the Electronic Communications and Transactions Act;
  • store or spread malware, phishing pages or any content designed to deceive or harm;
  • attack, probe or overload any system or network, including ours;
  • host content that is unlawful, including content that exploits children;
  • resell our services unless we have agreed to this in writing.

We may suspend a service without notice to stop serious harm, to comply with the law or a lawful order, or to protect our network and other customers. We will tell you why as soon as we can.

8. Content you host with us and take-down notices

You remain the owner of the content and data you store or send through our services. You give us permission to handle it only as needed to provide the services.

We do not monitor content hosted on our services. If we receive a take-down notice under the Electronic Communications and Transactions Act, we will act on it as that Act requires, and we will tell you. Take-down notices must be sent to our designated agent: Simbarashe G. Marima, Director, legal@fourthgeneration.technology, Plot 27860, Block 3, Gaborone, Botswana (postal: P.O. Box 550152, Mogoditshane, Botswana). These details are also shown on our Contact page.

9. Your data and privacy

How we handle personal information is explained in our Privacy Notice. Where we process personal information on your behalf as part of a service, our Data Processing Terms apply. We keep your data confidential and use it only to provide and support the services you buy.

10. Security and backups

We protect our systems with appropriate technical and organisational measures, described on our Security and Data Protection page. You are responsible for the security of your own devices, passwords and the users you give access to. Unless you have bought a backup service from us, you are responsible for keeping your own backups.

11. Service levels

Target availability and support response times for each service are shown on its service page. Where a service page offers service credits, those credits are your remedy for missing the target.

12. Liability

Nothing in these terms limits any right you have as a consumer that the law does not allow to be limited.

Subject to that, we are not liable for indirect or consequential loss, including loss of profit, revenue or data, and our total liability for all claims in any 12 months is limited to the fees you paid us for the affected service in those 12 months. These limits do not apply to loss caused by our fraud or wilful misconduct.

You agree to cover our reasonable losses caused by your breach of section 7.

13. Ending the agreement

You may close your account at any time once all services are cancelled and all invoices are paid. We may end this agreement if you materially breach it and do not fix the breach within 14 days of written notice, or immediately for a serious breach of section 7. When the agreement ends, you can export your data for 30 days, after which we delete it unless the law requires us to keep it.

14. Changes to these terms

We may update these terms. We will tell you of material changes by email and in the Cloud Console at least 30 days before they take effect. If you do not accept a change, you may cancel the affected services before it takes effect.

15. General

These terms are governed by the laws of Botswana. Any dispute will first be discussed in good faith. If it is not resolved within 30 days, either party may refer it to the courts of Botswana. Notices to you may be sent by email to your account's contact address. Notices to us must be sent to legal@fourthgeneration.technology. If any part of these terms is found invalid, the rest remains in force.
